The gap between the ‘haves’ and the ‘have nots’ has been growing steadily over time. The statistics are heartrending. Of the world’s adult population, 2% own greater than 50% of the world’s household wealth. Additionally, the upper 1% of the world’s adult population, as of the year 2000, owned about 40% of all the worlds’ assets. Further, 10% of the world’s richest people account for 85% of the world’s wealth. Sadly, the bottom 50% of the world’s adult population only manages 1% of the world’s wealth.These statistics can only be described as dismal (Davies, Sandstrom, Shorrocks & Wolff, 2006). According to the World Economic and Social Survey carried out in the year 2006, the growth of the world’s developing countries is dependent on domestic policies as well as the regional environment and global economic environment (Reducing International Inequality, 2006). Since it was found that developing c ountries are growing at a much less rate than their developed counterparts as far as technological advances are concerned, changes need to be made to make growth and development feasible.These developing countries are finding it difficult to come up with new activities that will strengthen the countries economy (Reducing International Inequality, 2006). Some of the changes that need to be made include the following: There is a need for macroeconomic stability with does not just mean low inflation, but includes the avoidance of fluctuations in business cycles as well as financial crises and external imbalances. This will increase investment and encourage growth within the country (Reducing International Inequality, 2006).The developing countries will also need to create new institutional reforms, guarantee property rights and create new markets. Institutional frameworks and regulations that are needful for the flourishing of markets must also be provided. The necessary public resourc es to ensure a thriving market should be put in place and rules must be fair across the board (Reducing International Inequality, 2006). Globalization has done a great job of opening up governments to the idea of a free-market. This in turn has opened up new opportunities in global trade as well as investment.With new markets comes a new potential for production to meet the demand, hence more income for the individual and the country (What is globalization? ). Globalization may help reduce the economic imbalances by renegotiating barriers that may be there in commerce, thereby establishing favorable agreements that will encourage trade in services, goods and investment. This is great for fostering foreign partnership with different corporations setting up shop in a developing country of choice bringing, employment opportunities and skills transfer to the people of the land which they can use in the future.This then increases their household wealth and raises the standards of the peo ple closing the inequality gap. Technology also has a great role to play. The internet for instance has made it possible for many people in developing countries to engage in e-commerce (What is globalization? ). This has transformed the economic lives of many people, especially computer literate youth. The advantages of information technology are vast and touch the lives of investors, consumers and businesses. People in any nation are able to learn about opportunities in a timely manner, which allows them to pursue the said opportunities faster.Additionally, the analysis of economic trends is faster. Collaboration and communication with partners in far away countries is instant and assets can be transferred at the click of a button. All these are ways that globalization opens up developing countries to opportunities all over the world and if maximized, these opportunities can lead to economic uplifting. (What is globalization? ). One cannot forget those that have no access to the in ternet though, or cannot afford it. According to the World Development Report 2007, majority of the worlds poor depend on agriculture for their livelihood.75% of the poor people in the world live in rural areas, of these 86% are dependent on agriculture (Boyne, 2007). Therefore one cannot speak of the development of wealth equality without addressing the issue of agriculture. According to this report, in order to meet the millennium development goal of reducing poverty and hunger by 50% by the year 2015 in these poor developing countries, agricultural development is a must. In order to make agriculture the mainstay of rural development it is important that the local authorities in any country make the environment suitable and supportive.Additionally, fair rules trade both nationally and internationally must be established, mitigating climatic changes as well as adopting to them and benefiting the poor (Boyne, 2007). The US being counted among the developed and richest countries in t he world is often called upon to assist or give aid to countries that are less fortunate. The money used for such funding is gained from the American tax payer. If the nations of the world were more stable due to equality in wealth distribution, it goes without saying that many of those countries would require only a fraction of the said funding or none at all.The US could then use the funds to carry out other projects or fund social programs such as welfare for those within the country that need the help. Additionally, social security funds would not be used to fund other programs leading to a deficit and fear as the baby boomers reach retirement age. More funding would go into research, fortifying the military or homeland defense, as well as many other projects that would be beneficial to the country. This would ease political tensions and bickering and allow elected officials to work without distraction.Internationally, it would enable to worlds countries to interact as equals. T he dominance asserted by the nations lending aid to poor countries would cease. This would reduce anti American sentiment in many of these poor nations. The opening of global markets is the best way to deal with the issue of unequal wealth distribution. Setting fair international trade regulations will be of great benefit towards this endeavor and agriculture, the main livelihood of the very poor, must be addressed.Benefits of this will be enormous to the US as it will enable the country to retain majority, if not all donor funds which can then be utilized for the benefits of the American people, who earned the money in the first place. The difference is, Hutus were killed as enemies, whereas the Tutsi were killed simply because they were Tutsi.4 Mamdani also suggests that â€Å"the genocidal impulse may be as old as organized power† and while â€Å"the impulse to destroy an enemy is ancient, the technology of genocide is constantly evolving†.5 Looked at in this way, it is difficult to predict genocide. If genocide is an impulse in much the same way as the impulse to kill one’s enemies, genocide like any act of violence is difficult to predict and just as difficult to prevent. History bears this out. Genocide is not specific to any particular location, politics, economy, race, ethnicity or gender. While there are specific themes such as ethnicity there are other themes that are far more subtle such as the influence of outsiders. Moreover, genocide has occurred on virtually every continent. The best explanation is that genocide is a result of â€Å"the conjunction of influences and actions widely present in the world.†6 Nsereko informs that, â€Å"the history of human race abounds with episodes of genocide.†7 Historically, genocide has been for the most part conducted during the course of a war. Evidence of this trend goes back to the Bible. In more recent times, the Nazis committed the holocaust executions during the Second World War. Other genocidal acts in the last century occurred in Turkey, Vietnam, Pakistan, Nigeria, Rwanda, Burundi, Iraq, Bosnia Herzegovina and Zaire.8 History also informs that genocide was not prevented by international customary law. Crowe informs that not only is genocide â€Å"as old as history†, but so are norms, standards and laws regulating standards of conduct during conflict.9 In 1943, the Allied Powers adopted a charter establishing the war tribunal for trying the Nazis for their war crimes. Some of the charges included genocide.10 On December 11 1946 the UN’s General Assembly adopted Resolution 96(I) in which genocide was characterized as a crime pursuant to international law. The White Australia Policy in the 20th century encouraged immigration only from Britain, but didn’t allow ‘Asians’ and ‘Non-whites (Economou N, 1998, p.363). By 1950’s people from all countries were allowed to migrate into Australia to help post war reconstruction. The colonial immigration saw a mass migration of European people mostly from Britain to Australia. It is said that between 1788 and 1852 approximately 170,000 people moved to Australia, and the gold rush era after 1851 made it a highly desirable country for migrating (Bessant Watts, 2002, p. 231). By end of World War two, as war forced Australia to get closer to other countries, which resulted in the first significant weakening of the policy in 1951. Later in the 1950s and 1960s other parts of the White Australia Policy were gradually dismantled. By the 1970s the federal government had removed all racial restrictions from its immigration law (Bessant Watts, 2002). Various writers have contradictory approaches and ways of looking at racism, making it a complex topic. It takes many different forms, ranging from physical violence to derogatory language. A person or group’s belief that their race is superior or inferior, or their moral and social traits are predetermined, based on biological differences can be termed ’racism’. A group of people sharing the same skin colour, same values, coming from the similar backgrounds may constitute as ’race’. One of the most common forms of racism found today is Institutional Racism, which stems from established corporations, and other powerful forces in society, thus making it hard to question and faces less public condemnation. Examples include housing, employment, businesses, education, religion and media (Healey, 2002). Typically, the basis of this type of discrimination is from irrational fear of people at the receiving end who belong to a different culture or ‘race’. Although, there have been ongoing debates about racism all around us for centuries, it is an assault on human rights as it methodically refuses people of different caste, colour, race, sex or their country of origin basic values underlined by Universal Declaration of Human Rights (UDHR) which states that human rights are everyone’s birthright and apply to all without difference (Healey, 2002). Common perception of shared origins, culture, lifestyle and traditions amongst a group of people or society is the universal definition of ethnicity (Bessant Watts, 2002). People can share the same nationality but have different ethnicities. A few writers have put forward fascinating explanations of ethnicity. Edward Shils in his ‘primordial approach’ argues that he believes everyone has a primordial attachment to their motherland, people and religion which brings out strong emotional ties by socialising, which further gives rise to the need to have a separate identity and belonging. Then the ‘Mobilisationist Approach’ suggests that nothing is predictable or normal about ethnicity. Rather, ethnic identities come into sight and are toughened in political contexts where groups struggle to get access to inadequate and valued resources (Van Krieken et al, 2000, p. 519). The basis of ethnocentrism is a conscious or unconscious belief that one’s ethnic group, culture, religion, custom or behaviour is superior to another ethnic group. Politicians boast that Australia is a multicultural, open and classless society. Despite the well known image of Australia’s everyone have â€Å"a fair go†, the country is still full of both institutional and popular racism. Education has always been very important when it comes to moving up in class and has been very liberating in Australian society. However, indigenous and ethnic groups have been somewhat disadvantaged in opportunities to acquire education. According to the Australian Bureau of Statistics only five Indigenous Australians per 1,000 obtain tertiary qualification, compared to 70-80 per 1,000 for Anglo Australians. In the 1990s welfare, health care and education support for Aborigines accounted only to 2% of total budget outlay (ABS 2000:21). In order to receive an education a person requires an income, but to get an income one needs a job, and a job is challenging to find without an appropriate level of education. Therefore an individuals chance of education is influenced by the socio-economic status of one’s parents which is a cyclic social inequality hard to break. Migrants and their children often find it challenging to adjust to the Australian school system as they often come from countries that have a poor education system, and even if they have tertiary qualifications they mostly are not recognised, resulting in them taking lower paid and lower status jobs. Working class children often attend schools in working class suburbs where pupils are directed into working-class jobs. A high number of students leave school early and the expectation that they will attend university is low. In comparison, upper-class children attend private schools, and the expectation that they will attend university is high. Migrants and ethnic groups are often at a lower end of the socioeconomic scale (Aspin, 1996, p. 87) Migrants arrive with little money and few skills. Already at a disadvantage with language barriers, migrants and ethnic groups are also faced with racism and discrimination in their search for employment. In 1996, One Nation political party leader Pauline Hanson made a speech that claimed that Australia was being overwhelmed by ‘Asians and feared that Asians were taking over jobs. The fact is that Asians at the time only accounted for 5% of total population and ‘there is little evidence to support the claim that high rates of immigration ‘cause unemployment or ‘cause Australians to lose their jobs (Bessant, 2002, p. 219). Indigenous people had a 24. 3% unemployment rate according to 1996 census (ABS 2000:23). Indigenous people are usually poorer than most non-indigenous Australians and receive a lower income on average than the total population. The household income for Aborigines in 1994 was $158 compared to $310 for white Australians (ABS 2000C:23) This also reflects the fact the there is a higher reliance by the Aboriginal population on social security payments (ABS 1996b: 122-4) Socioeconomic status is a major determinant of inequality as it influences access an individual has to the economic resources of a society. L. J. Aspin (1996) explains that white Australian-born males have a better chance of obtaining access to the resources of society. Inequality is also reflected in the differential access to housing and health services. For people who are paying rent and on a low income, it is almost impossible to save for a deposit on a house at the same time. Aborigines and migrants suffer discrimination in rental accommodation, where landlords preferring a two-parent, white, Anglo-Saxon families. Only 10% of Aborigines own housing compared to 70% of white Australia population (Aspin, 1996, p. 87). Most Aborigines live in rural and provincial Australia (Bessant, 2002, p. 226) far from big cities where there are more jobs, higher paid jobs, better education, better housing, good water and sanitation services, hospital medical services and other community amenities. Some ethnic backgrounds are still not accepted in our society and are treated differently and unequally. We see and hear about them on a day to day basis. In recent months the Indian community in Australia, especially students have become a vulnerable target for attacks, whether racist or not. On 31 May 2009 in Melbourne, about 5000 students marched through the streets of Melbourne protesting against these attacks on Indian, Pakistani and Bangladeshi students. 25-year-old Sravan Kumar Theerthala was in a serious condition in intensive care after being stabbed in the head with a screwdriver one week earlier (Bolton Peterson, 2009). In an article in The Age newspaper on February 19 Victorian police claimed that these attacks are not racially motivated, but opportunistic where Indian students are â€Å"over representing themselves as victims† and can be looked upon as soft targets. The police also advised them â€Å"not to speak in their native language loudly† or display signs of wealth. Attacks on Indians aren’t the only allegation Australia has faced over the years. It seems that anyone in power, including police, politicians or the media has had the tendency to somehow flare these attacks. In the Herald Sun on 11 June 2009, 3AW’s Neil Mitchell said: â€Å"Australians are also bashed and die in India, which does not provoke parades of chanting ocker backpackers in the streets of Mumbai†. In 2007, the then immigration minister Kevin Andrews referred to the Sudanese community when he said â€Å"Some groups don’t seem to be settling and adjusting into the Australian way of life as quickly as we would hope. † A spate of violent attacks were then unleashed against Sudanese migrants, and one was bashed to death by a group of white men (Bolton Peterson, 2009). As Australia continues to argue that it is a just, tolerant, open and classless society, there is still evidence of race and inequality among us and affecting the many lives of migrants and Indigenous people. It is interesting to note that the very determinants of class power, money, education, family background, occupation, health and general way of life are also the same factors where others experience inequalities. Race and ethnicity perpetuate inequality, and in any country including Australia, one would find that there are always some people with very strong values of racism, and media outlets which help in manipulating the views of general public. There still needs to be a massive drive by communities and governments on racism and inequality and it will be long before we will be a â€Å"happy multicultural Australia†. Immanuel Kant Theory of Justice The philosopher Immanuel Kant believed that his retributive theories of justice were based in logic and reason. The retributive stance on punishment states that punishment is necessary, and indeed, justified, on the basis that the act of committing crime deserves punishment. The strict guidelines Kants theories created, coupled with the very nature of retributive justice fuelled the arguments of those of Kants critics who claimed his approach would lead to harsh and ineffective sentencing. It is my intention to use this paper as a means of exploring and addressing these claims. Judicial punishment can never be used merely as a means to promote some other good for the criminal himself or for civil society, but instead it must in all cases be imposed on him only on the ground that he has committed a crime; for a human being ought never to be manipulated merely as a means related to anothers purposes First, he must be found to be deserving of punishment before consideration can be given to the utility of this particular punishment for himself or for fellow citizens  [1]  . Upon considering the above it is clear that, in Kants view, the only purpose punishment should serve is to penalize the criminal for committing a crime. Whether or not the punishment could have an affect on the criminals propensity to reform is therefore irrelevant. The punishment is there to punish the criminal for the crime they have committed; nothing more, nothing less. This leads on to the theory of just deserts. This theory is now considered to be one of the more prominent views on the subject of the punishment of criminals  [2]  . The key belief of the principle being that offenders must deserve punishment: [in] the everyday thinking about punishment, the idea of desert figures prominently. Ask the person on the street why a wrongdoer should be punished, [and] he is likely to say that he deserves it  [3]  . Kant advocated two principles regarding the way punishment should be meted out. As we have established above, the first of which is that the only right and proper grounds for punishment is that the criminal deserves it. And so it follows that punishing a criminal with the aim of promoting happiness, reformation or deterrence would run contrary to the categorical imperative by making the punishment a means to an end. Kants categorical imperative is the universal law that states that all people must act in a morally correct manner at all times. Therefore ones own desires or wishes cannot be taken into account when making a decision, as no one persons desires should be prioritized above anothers. The desired outcome of any action must be to avoid causing harm or inflicting damage upon another person. In this regard, Kant defines an act as morally correct if it can be applied as a universal law. For example: I will never tell the truth would be deemed to be immoral because it could not b e applied as universal law as, in the event of everyone having to never tell the truth, the truth would lose its significance. In simpler terms, when considering Kants categorical imperative, the logical approach surely dictates that we must consider the affect our own actions will have on others, and then to avoid carrying out actions that will harm or hinder the rights of others. The second of Kants principles regarding punishment relates to proportionality; the sentence received should be proportionate to the crime committed. Kants theories of autonomy and free decision making make up the foundations for his view on just deserts. The theory submits, first of all, that everybody is duty bound to respect each others rights. Kant goes on to suggest that adhering to the law is a sacrifice of ones right to freedom of choice. Therefore, those that commit crime gain an unfair advantage over those that do not. Punishment is used as a means to redress the balance between the law abiding citizens and the criminals, removing any unfairly gained advantage from the criminals. The punishment is intended to punish no more or less than relates to the advantage gained. It follows, therefore, that deterrence and reformation bear no relevance to this method of sentencing. This type of justice system is still relevant today, and indeed, has been put to use by some governments. The U.S. State of California has rigorously applied retributive punishment philosophies to its court system. Retributive justice has been applied in California since the inception of the Determinate Sentencing Law: The Legislature finds and declares that the purpose of imprisonment for crime is punishment  [4]  . One of the key policies of Californias justice system is the three strike rule. The three strike rule was introduced in 1994  [5]  . Its main purpose was to punish repeat offenders by handing out long sentences a minimum of twenty-five years to those that have been convicted of a felony and already have two strikes for violence on their record. Sentencing under these guidelines leads to particularly long, and critics say, ineffective, sentences  [6]  . The policy has been successful in that it has kept criminals off the streets for longer  [7]  , but it can be argued that the detrimental effects, such as criminals receiving life sentences for what amounts to petty offences the third strike doesnt have to be a violent offence outweigh the beneficial effects. This policy also conflicts with Kants categorical imperative in that receiving a life sentence for being convicted of shoplifting  [8]  (as the third strike) is not proportionate. We have already established that Kants intention is for individuals who have been found to have broken the law to receive punishment that is relative to the advantage that they have gained by committing the crime. If the above assessment were to hold true it would mean that Andrew von Hirschs proclamation regarding the opinion of the person on the street  [9]  would surely be correct. Despite this, one could argue there to be various potential flaws present within the theory. Not the least of which is how to apply this theory of punishment to a criminal that has gained no discernible advantage from their crime. For example: A boy living alone with his mother is periodically abused by her. He is subjected to sustained mental, physical and sexual assaults that he is powerless to prevent. He is kept locked up for the majority of his time at home and is threatened that, were he to tell anyone of what he has suffered, he would receive more severe abuse. The abuse continues as he grows older and eventually he fights back. On this occasion he hears his mother approaching him via the stairs that lead to his room. He rushes to the top of the stairs and pushes her down them, resulting in her death. I would suggest that it is certainly arguable that the boys only intention was for the abuse to stop, rather than an intention to kill or seriously injure his mother. SOURCE IT UP It surely would not be right to say that there has been any advantage gained in this example. The rest of society is not expected to endure such abuse, and so it follows that the boy was already at a disadvantage. Also, surely th e victim in this crime was herself guilty of not respecting the rights of her son, as per Kants theory of just desert. This would surely lend weight to the line of thinking that it would be unfair to punish the criminal in this, albeit radical example, where there has been no advantage gained, by the very same principles applied to those that have gained some advantage. This example seems to support the beliefs of Kants critics  [10]  , and certainly strengthens the view that two wrongs dont make a right. Kant endorsed capital punishment as a suitable punishment for murderers  [11]  . This stance is a good example of Kants beliefs regarding proportionality; a life for a life. However, this stance also goes some way to strengthening the claims of those that believe Kants philosophy encourages harsh sentencing  [12]  . This leads on to the area of Kants philosophy that has attracted the most criticism. How can ending the autonomy of another, criminal or otherwise, be in keeping with Kants theories regarding categorical imperative? To use Kants own words, to hand out capital punishment must surely be classed as FIND SOME RELEVANT WORDS. Why is it that this stance can be upheld in relation to suicide or murder, but disregarded when it comes to the punishment of a criminal? Again, we turn to the view of Andrew von Hirsch, who said: A person who violates the rules has something others have the benefits of the system but by renouncing what others have assumed, the burdens of self-restraint, he has acquired an unfair advantage. Matters are not even until this advantage is in some way erased à ¢Ã¢â€š ¬Ã‚ ¦ Justice that is punishing such individuals restores the equilibrium of benefits and burdensà ¢Ã¢â€š ¬Ã‚ ¦Ã‚  [13]   Kant justifies such an approach by saying [the criminal] draws the evil deed back to himself when he suffers that which according to the penal law is the same as what he has inflicted on others. According to this line of thinking, a criminal that has murdered somebody else has done so because they have made a choice to do so, and in doing so, they have gained an advantage over the victim. In other words: A kills B because A didnt like the look of B. By murdering B, A has sought to gain an advantage over the rest of law abiding society, who by adhering to the law, have sacrificed their freedom of choice. So, As choice to murder B, is deemed to be A unfairly reclaiming his freedom of choice. However, if A is punished via capital punishment, it is not to gain any advantage, it is merely to punish A for the crime he has committed in a proportionate manner. He has taken a life, therefore his own becomes forfeit. Again, though, there is a case for arguments against Kants stance on the ma tter. How can theory stand up in cases where the criminal has not acted out of any rational thought? How can Kants view apply in cases where the criminal has lost their mind to insanity and acted on instinct rather than choice? There is no reason, no autonomy in such an instance. In conclusion, I believe Kants theory on punishment to promote certain values which are of utmost importance to society. Namely, the categorical imperative and, in particular, his view on morally correct actions. However, there is perhaps, something robotic about his theory. It would be wonderful if everybody told the truth all of the time, regardless of consequence. It would be equally wonderful if people did not commit crime at all. I believe that asking everyone to follow the same universal laws, while noble and beneficial in theory, cannot be achieved due to the complexity and intrinsic selfishness of human beings. Similarly, to punish them in such a way; without taking deterrence, the propensity to reform, or any other individual factors pertaining to a given case, such as circumstance and state of mind, would be unfair. While I agree that proportionality would offer certain advantages when sentencing, such as adherence to the rule of law; everyone is treated equally. Kants stan ce on punishment also presents its fair share of problems.
